Terms & Conditions

These Terms and Conditions set out the basis on which Bistari provides home support coordination services and how we expect both parties to work together. Please read this page carefully before making an enquiry or entering into a service arrangement with us.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

  • "Bistari", "we", "us", "our" — the coordination service operated from No. 33, Jalan Lintang, 93100 Kuching, Sarawak, Malaysia.
  • "You", "the family", "the client" — the person making an enquiry or entering into a service arrangement with Bistari.
  • "Older adult" — the person on whose behalf home support coordination is being arranged.
  • "Service" — any of the coordination offerings described on our website, including check-ins, companionship visit coordination, and caregiver guidance workshops.
  • "Website" — the site accessible at https://bistari.biz.
  • "Agreement" — these Terms and Conditions together with any written service confirmation provided to you.

2. Acceptance of Terms

By using our website, submitting an enquiry form, or entering into any service arrangement with Bistari, you confirm that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and accept these Terms and Conditions in full.

If you are acting on behalf of another person or family, you confirm that you have the authority to do so and that this Agreement is binding on all relevant parties.

3. Services Described

Bistari provides home support coordination services only. Our role is to organise, schedule, and follow up on the arrangements described below. We do not provide regulated health, nursing, medical, or social work services.

Regular Check-in & Family Updates

Scheduled friendly phone or in-person check-ins, with brief written summaries shared with the family. Single coordination point. Priced from RM 680/month.

Companionship Visit Coordination

Arranging regular friendly visits for conversation, shared reading, hobbies, and gentle walks. Includes companion matching and written updates. Priced from RM 1,600/month.

Caregiver Guidance Workshops

Plain-language sessions for family members on daily routines and home comfort. Includes printed guides, a session recording, and follow-up questions. Priced from RM 4,700/package.

Service availability is subject to schedule and location. We will discuss and confirm the scope of any arrangement before it begins.

4. Enquiries and Arrangements

Submitting an enquiry through our website does not constitute a binding agreement. A service arrangement is only confirmed when both parties have agreed on the scope, schedule, and fees in writing (including by email). We will not begin any service until this confirmation is in place.

We reserve the right to decline any enquiry at our discretion, including where the requested scope falls outside what our coordination service covers.

5. Your Responsibilities

You agree to:

  • Provide accurate and current information when making an enquiry or confirming a service.
  • Inform us promptly of any changes to your family member's circumstances that are relevant to the coordination arrangement.
  • Ensure that a suitable home environment and access are available for any arranged visits or sessions.
  • Use our website and services only for their intended purpose and in a manner that is respectful to our staff and coordination partners.
  • Not attempt to use our website to submit false enquiries or interfere with its operation.

6. Payment Terms

Fees are stated in Malaysian Ringgit (RM) and are as quoted in your service confirmation. Payment terms, including due dates and accepted methods, will be outlined in the confirmation document provided to you.

Fees are non-refundable once a service period has commenced, except where Bistari is unable to deliver the agreed service due to circumstances on our side. Partial refunds for unused portions of a package may be considered on a case-by-case basis and communicated in writing.

Prices listed on our website are indicative and may be updated at any time. The price that applies to your arrangement is the one confirmed in writing before the service begins.

7. Intellectual Property

All content on this website — including text, layout, and design — is the property of Bistari or used with permission. You may view and print pages for personal, non-commercial use only. You may not reproduce, distribute, or commercially use any content from this website without our written consent.

Printed guides and session recordings provided as part of a workshop package are for personal reference by the attending family member only and may not be redistributed.

8. Disclaimers

Our services are coordination and companionship support only. Bistari does not provide medical, nursing, psychological, social work, or any other regulated professional service. Nothing on our website or in our materials should be read as professional advice of any kind.

We make reasonable efforts to ensure that our website information is accurate and up to date, but we do not warrant that all content is free of errors at all times. The website and its contents are provided on an "as available" basis.

9. Limitation of Liability

To the extent permitted by Malaysian law, Bistari's liability to you in connection with any service or use of our website is limited to the fees paid by you for the specific service in question in the month in which the issue arose.

We are not liable for indirect, consequential, or incidental losses arising from our services or from your use of our website. We are not liable for disruptions to service caused by circumstances outside our reasonable control, including but not limited to weather, public health situations, or third-party cancellations.

10. Termination

Either party may end a service arrangement by giving reasonable written notice, typically seven (7) days for monthly services or as stated in the service confirmation. We reserve the right to discontinue services immediately where a client's conduct is harmful or abusive to our staff or coordination partners.

On termination, any fees paid for the current period are non-refundable unless Bistari is at fault. Any obligations that, by their nature, survive termination — including payment of outstanding fees and intellectual property restrictions — will remain in effect.

11. Governing Law & Disputes

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising in connection with these terms shall first be addressed through direct discussion between the parties. If unresolved, disputes will be referred to the courts of Sarawak, Malaysia.

Consumer rights under Malaysian consumer protection legislation are not affected by these terms.

12. Changes to These Terms

We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
